Why Are HOA Elections Held to a Higher Standard?

eBallot is an online voting platform that homeowner associations and community associations use to run board of directors elections, recall votes, and amendments to governing documents. HOA elections are unusual because the rules are written into state law rather than left to the association. California alone has more than 50,000 associations, and the Davis-Stirling Act requires board elections to be conducted by secret ballot, overseen by an independent inspector of elections who cannot be anyone already under contract with the association. Since January 2025, electronic secret ballots are permitted for most of those elections. What has not changed is the standard the ballot itself has to meet.
